Arrests made in murder of 5-year-old boy

MODESTO, CA (KTXL/CNN) - It's been three and a half months since 5-year-old Xavier Smith, known as Bubba, was shot and killed while playing in the garage of his home, but thanks to a string of arrests, closure may be on the horizon.

"To be honest, I'm pretty happy they got the killer,” said Remzi Sliwo, Smith’s former neighbor. “Nobody should kill kids or anybody else. That's not God's law, God's way."

Sliwo has lived in the neighborhood for a little less than a year, rallying together with other neighbors to help the Smith family.

He was ecstatic when he found out Santa Cruz police had arrested Robert Davis, 21, late Friday night at a motel for killing Smith.

Davis’ arrest will likely bring some closure to family and friends of 21-year-old Cody Lea as well.

Lea was shot and killed at Ustach Park in November, and Modesto police believe Davis pulled the trigger there, too.

Modesto Police also arrested 20-year-old Ryan Desouza, who they believe was driving Davis the night 5-year-old Smith was shot.

Additionally, police arrested 21-year-old David Wilmore Jr. for being an accomplice with Davis when he allegedly shot Lea.

Both were booked on murder charges.

The arrests come less than a week after Modesto Police released a video of the car they believe was involved in the shooting of Smith.

Knowing someone will pay the price for the death of the boy is all Sliwo wanted.

"No one deserves to be killed or shot or stabbed or anything like that,” Sliwo said. “For a little boy, that's very, very sad. That little boy, he passed away, he died. He's not going to grow up, see his years, his days, his family, his job, his future."
