TALLAHASSEE, Fla. (WTXL) - A Tallahassee man sentenced to life in 2011 for a double murder in 2009 has been transported from a state prison to Leon County to await a motion hearing.
Victor S. Hamilton, booked into the Leon County Detention Center on Wednesday, received a November 14, 2017, hearing date.
He was convicted in the killing of two men on Aug. 20, 2009, at a Holiday Inn on Tennessee Street.
In part, he is seeking to appeal his sentence on the grounds that the state attorney improperly shifted the burden of proof.
He also says his assigned legal representation did not accurately represent him by failing to file a pre-trial motion to prevent the state from displaying at his trial the AK-47 found on the scene.
Additionally, he claims his legal representation did not represent him to the best of their ability.
He was granted a post-evidentiary hearing, where both parties reviewed previous evidence and legal representation for accuracy.
In 2009, Hamilton was convicted of killing Earl Wright and Otis Stewart. He was found guilty of aggravated battery with a firearm and shooting into an occupied building.
During a fight at the hotel, Hamilton, according to a probable cause affidavit from September 2009, retrieved a gun from his car and fired three to five rounds high above the crowd and then several rounds into the crowd.
Officers said more than 100 people had gathered at the hotel for an after-hours DJ party.
Witnesses and video from both the hotel and the Moon nightclub, where there was a TJ's DJ event on Aug. 19, 2009, identified Hamilton.
He has been serving his sentence at the Liberty Correctional Institution in Liberty County.
