TALLAHASSEE, Fla. (WTXL) - A Tallahassee man is behind bars after officers say he attacked his co-worker because he kept calling him "retarded."

According to court documents, officers were flagged down at the Leon County Health Department by a victim in December.

Officers say the victim told them that he has attacked at a work site by another employee. The victim said 38-year-old Kane Dempster randomly grabbed him by his shoulders and said "I'm going to mess you up," as he continued to attack the victim.

Minutes later, the victim was finally able to free himself. Documents say the victim was transported to a local hospital after complaining about back injuries.

Days later, officers spoke with the employer who told them that he had fired Dempster after hearing about the incident.

Officers also spoke with Dempster who said while he and the victim was working at a site together they got into an argument because the victim kept calling him names. Dempster told officers that the victim kept calling him "retarded" so he told him to stop.

However, Dempster said the name-calling continued and he was tired of it, so he grabbed the victim to make him stop.

Based on the evidence, Dempster was arrested and transported to the Leon County Detention Center on Tuesday. He is being charged with battery.
