WEST ALLIS, WI (WITI/CNN) - Though officers fired 67 times at a robbery suspect back in May, no charges will be filed against them.
The officers shot and killed the suspect, Maxwell Holt.
According to the medical examiner's report, at least 40 of the 67 bullets struck Holt. He died at the scene.
The Milwaukee County District Attorney's office determines the officers are justified after the Oak Creek Police Department conducted an independent investigation of the incident.
Records released Tuesday explained Holt first allegedly robbed a restaurant
Investigators said he left the scene and was picked-up by 26-year-old Jessica Okruszynski.
Eventually, a West Allis police officer pulled the two over. Holt got of the car and "pointed a firearm at ... (the officer's) marked squad (car) and fired three shots."
Holt ran from the scene, and officers found him hiding in a trash bin.
When officers lifted the lid of the bin, they said Holt held up a gun, pointing it at them and saying "bang."
At that point, five officers from West Allis and New Berlin police departments started firing.
"I can't believe that they would feel 67 shots were necessary," said Faye Wolff, Holt's sister, who is upset with the DA's decision.
"They could have used a Taser, used pepper spray," she said. "We're all still shocked about it."
