CHESAPEAKE, VA (WTKR/CNN) - Tuesday was the preliminary hearing for the Virginia security guard charged with shooting and killing a man while playing Pokemon Go back in Jan.
For more than an hour, a handcuffed 22-year-old Jonathan Cromwell stared straight ahead as members of the Chesapeake police department told a packed courtroom about what they found the night Jian Sheng Chen was shot and killed.
According to Tuesday's testimony, police were called to the riverwalk area of the city on Jan. 26.
Once on scene they found 60-year-old Chen slumped over in his van, and Cromwell was still on scene with his gun in his holster.
The testimony revealed that Chen was shot five times, though at least seven shots were fired by Cromwell.
Police testified that Cromwell began shooting Chen through the driver's side window and continued shooting while side stepping towards the front of the van.
According to a foresnic pathologist, the shots were not fired from a close range and none of the bullets exited Chen's body.
Family and friends of Chen said the details of their loved one`s death were difficult to hear.
In court, Cromwell's attorney said his client's actions were not malicious, but out of self-defense.
His attorney says Cromwell was only doing his job and feared for his life when Chen began revving his engine and driving towards him.
His family had no comment outside of the courthouse today.
Cromwell told police Chen had been banned from the riverwalk club house property, where the shooting occurred.
A trial date for Cromwell has not yet been set.
