MISSOULA, MT (RNN) – The folks at Arby’s say it began when Daniel Stine asked for a cup to get some water.
But before the afternoon was over, the 48-year-old was charged with felony robbery and four misdemeanors – obstructing a peace officer, resisting arrest, disorderly conduct, and criminal trespass.
Stine is accused of getting a soda from the fountain, instead of the water he requested.
“When confronted by an employee who informed him that he had to pay for the cup of soda, he refused and left out one of the entrances,” Missoula Police Public Information Officer Travis Welsh told KGVO.
“The employee followed him, told him that he was not welcome back, then he turned and came back towards the employee and tried to kick that person before walking away again.”
Police arrived on the scene after the altercation and noticed Stine entering a nearby Denny’s, where he hid in the men’s room.
"The officers were able to make entry to the bathroom, however, when they did and confronted the man, rather than comply with their instructions he approached them in what appeared to be an aggressive manner," Welsh said.
"The officers attempted to take control of him physically and that's when he began to resist and fight with the officers and had to be tased to comply to the officer's instructions."
Initial bail for the Aug. 9 incident was set at $50,000.
That’s a pretty pricey cup of soda.
