FRAMINGHAM, MA (WCVB/CNN) - A 44-year-old Massachusetts man appeared in court on Tuesday for allegedly breaking into a family's home.He didn't steal anything except a bottle of wine, which he drank and then fell asleep inside the house.

Vaughn Buckley made an appearance in a Framingham courtroom for an unwelcome appearance in a Framingham home on Monday night.

"I had just come home from work, and so she (his wife) just said there's a man sleeping downstairs in our son's bed,” homeowner John Walsh said. Walsh says his wife first discovered the intruder who prosecutors say broke a basement window with a brick to get inside.

Buckley allegedly knocked over some personal items, and then made himself at home. "He helped himself to a bottle of wine in the refrigerator,” Walsh said. Buckley drank the wine according to prosecutors, then fell asleep in a bed awakened by the homeowners.

"He was very passive so, just talked, couldn't explain why he was there, I called the police,” Walsh said. Buckley was charged with unarmed burglary and destruction of property.

The judge denied him bail because he violated probation in a previous case.
