TALLAHASSEE, Fla. (WTXL) - A man has been arrested for video voyeurism, accused of secretly recording the victim while she was nude. 

Diego Alejandro Cardenas-Leon, 23,  of Tampa, used his phone to take a photo of the victim while she was nude and "coming out of a deep sleep," according to a probable cause affidavit. 

In mid-to-late September 2017, the victim said, she confronted Cardenas-Leon after she woke and realized he had taken a photo of her without her permission. She said the photo was stored on his "Snapchat memories" and during the confrontation his phone died.

After Cardenas-Leon yielded to the victim's demand that he show her the photo, he told her he would delete the photo because it upset her, the court document said.

Months later, in December 2017, the victim said Cardenas told her he had not deleted the photo despite his earlier statement to her.

The victim said she also remembered that Cardenas had told her he had other photos of her that were not "as bad" as the photo she saw when she caught  him.

On April 9, 2018, the victim called Cardenas. She said that he answered the phone saying "they're gone, they're gone."

When the victim told him he previously said he would delete the photos, court documents indicate, he replied, "I'll delete them tonight."

The victim said she repeatedly asked Cardenas-Leon to delete the photos but believes that, based on her conversations with him, they continued to exist.

After Snapchat was served an electronic search warrant April 26, 2018, on June 29, 2018, the service sent the Tallahassee Police Department investigator a photograph as described by the victim.

On July 5, 2018, Cardenas-Leon, speaking to the investigator by phone, admitted to taking the photo and that it was "morally wrong" and "legally wrong."

He said that the victim was unaware of him taking the photo when he took it and had confronted him afterward.

Cardenas-Leon said he was sure the image was deleted from Snapchat "and seemed to be checking while I was on the phone with him," the investigator wrote.

Cardenas-Leon said there were no other images and denied that anyone else had seen the image of the victim.

He was released from the Leon County Detention Center on Tuesday on a $2,500 bond.
