TALLAHASSEE, Fla. (WTXL) - A Tallahassee man faces multiple charges after choking and biting his girlfriend to get her cellphone in order to see if she was talking to other men.
Nathaniel Livingston, 26, was arrested by the Leon County Sheriff's Office on Monday.
On June 18 around 6:43 p.m., deputies responded to Shelfter Road in response to a domestic disturbance.
When deputies arrived they spoke with the victim. She stated her and Livingston were driving when they began to argue about her iPhone 7 plus.
She told deputies she stopped at the intersection of Hannon Mill Road and Crawfordville Road because he wanted to go through her phone to see if she was talking to other men.
The victim said she grabbed her phone from the center console, at which point she stated Livingston grabbed her by the throat.
She informed deputies she could not breathe and felt like she was going to pass out.
The police reports states, he then let go of her and grabbed her phone.
According to the police report, when she reached across him to try and get her phone back, he bit her on the neck.
Arrest documents state she was able to get her phone back and as she tried to call 911, he grabbed her phone and got out of the car.
The victim stated he reopened the door, got his phone, slammed the car door, and walked away.
She said Livingston started yelling at her and hit the front of her car with his fist, causing a large dent. As the victim drove by him trying to get away, he kicked the passenger side door causing another dent.
Deputies determined the estimated damage to the victim's car was $1,500.
After leaving the scene, deputies were told the "brother" of the victim had gone and gotten the cellphone from Livingston.
Deputies then went back to the scene to try and find where Livingston was.
The "brother" was reluctant to say exactly where he met with Livingston, but told deputies he was around the McDonald's on Orange Avenue and South Monroe Street, wearing "blue baller shorts, black shoes, and a white t-shirt," and that he had dreads.
Deputies saw Livingston go into ASAP Smoke Shop where they made contact with him and arrested him.
A worker from ASAP Smoke Shop gave deputies Livingston's knife and Nike visor.
While talking with deputies, he said he was arguing with the victim about her talking to other guys on her phone.
He stated he took the phone because "what would you do if your girl was talking to other guys' Of course I didn't give it back."
He told deputies the victim then got angry and put him in a headlock. Livingston admitted to biting her while in the headlock, but said it was out of self-defense.
When deputies asked him how he got into the headlock, he was unable to provide a reason.
He denied choking the victim and said he got out of the car to walk away. He also denied punching or kicking the car, but then said he did as she drove by him.
When deputies asked about the knife, he said he had it because he "was afraid of her brother." He said he got the knife from a friend's house, but would not tell deputies who.
During a search of Livingston, deputies found a Department of Children and Families Supplemental Nutrition Assistance Program card in the victim's name in his pocket.
Based on the evidence, Livingston is being charged with domestic battery by strangulation, domestic battery touch or strike, damage property ($1,000 or more), grand theft ($300 or more but less than $5,000), and obstruction of justice by intimidation.
He was taken to the Leon County Detention Facility.
