TALLAHASSEE, Fla. (WTXL) - UPDATE: Today, a special ceremony will be held to swear-in the re-elected Commissioner Scott Maddox.

This announcement comes after the courts decision Monday that Maddox is a resident in the Capital City and therefore will be able to serve the community.

The District Court of Appeals raised the lift of stay on Maddox today. Tallahassee Resident Dr. Erwin Jackson said he does not intend to appeal what the judge ordered.

The ceremony will take place at 5 p.n. in the City Hall Mezzanine on South Adams Street.

TALLAHASSEE, Fla. (WTXL) - After Thursday's trial was cut short, Commissioner Scott Maddox is expected to be back in court Friday for claims that he doesn't live within Capital City limits.

As he appears in court for a hearing, Maddox will be dealing with a suit that claims Maddox does not live within city limits and therefore can't serve as a commissioner.

A judge originally threw out that suit saying that Maddox did indeed qualify.

But an appellate court has overturned that ruling, saying the court did not address pending motions.

Judge Karen Gievers agreed to continue Thursday's proceedings on Friday in order to give the prosecution more time to question Maddox.
