TALLAHASSEE, Fla. (WTXL) - A Tallahassee man will spend 10 days in jail for punching a Circle K employee he believed was using voodoo on him.
"I punched you because you tried to use voodoo on me!" James L. Dillion, 62, told the victim as a Tallahassee Police Department officer was placing him in a patrol car.
Dillion was arrested Tuesday on a battery charge after a TPD officer found him in the Circle K at 2683 Sharer Road, according to a probable cause affidavit.
Police were called to the area about an intoxicated man, "carrying a quart of beer," who "was screaming at people in the parking lot."
According to the victim, Dillion had come to the gas station yelling and causing a disturbance. When the victim asked Dillion to leave, Dillion punched him in the stomach and threatened to beat him up.
The victim told the officer he wasn't hurt but wanted to press charges.
While on scene, officers spotted Dillion walking back into the gas station's store and went to talk to him.
When officers told him he was the suspect in their battery investigation, he immediately replied, "I punched him in the solar plex because he tried to use voodoo on me!" Police detained him and led him outside to a patrol car.
The arrest report says the victim walked to the police car in the parking lot and identified Dillion as the one who assaulted him. As police put Dillion in the car, he spotted the victim and said, "I punched you because you tried to use voodoo on me!"
On Wednesday, Dillion plead no contest to the charge and was sentenced to 10 days in jail where he remains.
