JACKSONVILLE, Fla. (AP) — A northeast Florida man twice convicted of killing his neighbor has been sentenced to death for the second time.
Following a jury's recommendation, a Duval County judge sentenced 25-year-old Randall Deviney on Wednesday. He was convicted in July of first-degree murder. The Florida Times-Union (http://goo.gl/jPt5ss) reports that the jury made additional findings that the murder was premeditated and occurred during a burglary and an attempted sexual battery.
Deviney was previously sentenced to death in 2010, but the Florida Supreme Court threw out that conviction because Jacksonville police continued to interrogate him after he invoked his right to remain silent.
Authorities say Deviney slit 65-year-old Delores Futrell's throat in 2008. He said he snapped when she tried to get him to talk about his past abuses.
