Man arrested in deadly Old Bainbridge Road shooting

TALLAHASSEE, Fla. — A man has been arrested for a deadly shooting in Tallahassee that left a victim lying near the intersection of 6th Avenue and Old Bainbridge Road.

Herbert Newby Jr., 30, has been arrested in connection to a deadly shooting on Old Bainbridge Road in early November.

According to court documents, at around 6:08 p.m. on Nov. 11, Tallahassee Police responded to the intersection of Old Bainbridge Road and West 6th Avenue.

When they arrived, they found a man lying in the road with gunshot wounds. That man was then transported to a hospital where he later died from his injuries.

"Interviews with friends, family and acquaintances revealed [the victim] was a known user of synthetic marijuana and he sold crack cocaine to support his synthetic marijuana habit," court documents read.

Witnesses told officers that the victim began behaving erratically and became known for failing to pay back his drug suppliers in full or on time.

One week before the victim was killed, witnesses said he and Newby got into a fight.

Witnesses told officers that the victim was upset with Newby because he allegedly sold him low-quality drugs. The victim wanted the drugs to be replaced, but Newby refused the request.

Documents say cell records also placed Newby in the area of the shooting.

Based on the evidence, Newby was taken into custody by TPD’s Career Criminal Unit and transported to TPD for questioning.

When officers searched a home on Shelfer Road where Newby was staying, they found a handgun reported stolen out of Jefferson County, various types of gun ammo, several small baggies of synthetic marijuana or spice, Alpha-PVP and drug paraphernalia.

Newby was arrested and charged with second degree murder, possession of a controlled substance without a prescription, and several gun charges related to possession of a weapon by a Florida felon.


Tallahassee police say the victim that was shot Monday night on Old Bainbridge Road has died from their injuries.

As the investigation continues, police have ruled the shooting as a homicide.

When officers arrived on scene, they found a victim suffering from a gunshot wound in the roadway. That victim was taken to a local hospital with serious injuries.
