JACKSONVILLE, Fla. (WTXL) — The lawyer for the family of Jamee Johnson, Harry M. Daniels announced he would be filing a federal suit on behalf of the Johnson family against all those involved in the death of Johnson.

Daniels' statement references the body camera footage released by the State Attorney's Office Fourth Judicial Circuit of Florida, saying the footage confirms that Johnson's shooting was not justified. Daniels says at the time Jamee was shot "it is undisputed that he was unarmed and outside his vehicle."

According to the statement, the Jacksonville Sheriff's Office's original statement was contrary, saying Johnson was shot inside the vehicle.

Daniels also said JSO is in possession of an eyewitnesses statement that Johnson was "shot and killed with his arms up while surrendering."

We find it very troubling and a dereliction of duty on behalf of the State Attorney's Office not to investigate the accounts of an eyewitness and to allow JSO to investigate their own officer involved shootings.

Johnson's family has maintained the shooting was unjustified.

This is a developing story.
