Judge denies motion to dismiss charges against Scott Maddox

A U.S. district judge has denied a motion to drop corruption charges made against city commissioner Scott Maddox.

The motion was to dismiss many of the charges that were filed against Maddox after he was indicted on 44-counts of bribery and fraud charges in December.

According to documents, Chief U.S. District Judge Mark Walker denied the motion on Tuesday.

In the ruling, the Judge noted that a court may not dismiss an indictment "on a determination of facts that should have been developed at trial." He also noted that a motion to dismiss does not “provide for a pre-trial determination of sufficiency of the evidence.”

Maddox, along with his business partner, Paige Carter Smith, are accused of taking bribes through their company, Governance Inc., in exchange for Maddox's influence at City Hall.

The two are expected back in court on Friday.
