TALLAHASSEE, Fla. (WTXL) — An appeals court has reversed a trial court's decision to dismiss a felony hazing charge against three men accused in the hazing death of Andrew Coffey.
The appeals court said the trial court should not have dismissed a felony hazing charge against Anthony Oppenheimer, Anthony Petagine and Luke Kluttz.
The appeals court did agree with the trial court's decision, to allow the state to proceed with the misdemeanor hazing charge.
Coffey was found unresponsive at a Pi Kappa Phi fraternity party back in November of 2017.
Authorities say he was pressured to drink a lot of alcohol and died of alcohol poisoning.
His BAC during his autopsy was almost six times the legal limit to drive.
The five other defendants took a plea deal.
