TALLAHASSEE, FL (WTXL) -- A grand jury in Leon County cleared Tallahassee Police Officer Nicholas Lowe of any charges on Tuesday, saying that he acted justifiably when he fired two rounds at Broderick Davis this June.
The grand jury ruled that Officer Lowe was in imminent danger after Davis fired at the officer during a foot chase.
Court documents say that Lowe noticed Davis when he was acting suspiciously after coming out of the woods along Joe Louis Street on the evening of June 19th.
According to police, as Lowe approached Davis, he reached into his pocket and began to run. As Davis was running, Lowe fired his gun at Davis. Davis returned the shot near the 1000 block of Volusia Street.
After Davis was eventually caught, the police say they connected him to an earlier disturbance at his Blountstown Street Home. Davis' ex-girlfriend said that he broke several of the house's windows and that she heard gunshots that she thought were fired by Davis.
Davis has been charged with attempted homicide of a law enforcement officer and possession of a firearm by a convicted felon.
Lowe's clearance follows two similar cases, where a grand jury found officers were acting lawfully when firing shots outside of Tallahassee night clubs in two separate incidents this June. Another group of officers were cleared in May after they shot and killed 39 year old Tommy Jackson and injured 40 year old Arthur James.
