ATLANTA, Ga. (WTXL) - Georgia's Attorney General says the state has no right to require food stamp recipients to submit to drug testing.
Attorney General Sam Olens has written a letter to Governor Nathan Deal, siding with the federal government's assertion that such provisions are in violation of federal law.
Federal law prohibits states from attaching any additional stipulations such as drug testing to the Supplemental Nutrition Assistance Program.
Governor Deal previously signed a law requiring any food stamp recipients suspected of drug use to undergo testing. But Olens says federal regulations from the U.S. Department of Agriculture trump the state law.
