TALLAHASSEE, Fla. (AP) - The Supreme Court denied an appeal of a man scheduled to be executed Nov. 12.
The court issued its opinion Thursday, rejecting the argument from Darius Kimbrough's lawyers that he shouldn't be executed because the jury recommendation wasn't unanimous.
Kimbrough broke into the Orlando apartment of 28-year-old Denise Collins as she slept in October 1991. Kimbrough sexually assaulted Collins and then beat her to death.
Police eventually connected Kimbrough to Collins' murder through DNA evidence. But before that, Kimbrough reportedly burglarized the apartment of another woman and sexually battered her, as well.
A jury recommended the death penalty on an 11-1 vote.
