MIAMI (AP) — The FBI is resisting turning over thousands of classified phone intercepts to a Florida man who is suing the U.S. government for malicious prosecution after he was cleared of supporting the Pakistani Taliban terror group.
The FBI contends it would take about two years to declassify and translate up to 40,000 calls before they could be provided for Irfan Khan's lawsuit. Attorney Michael Hanna wants to find out if any calls show prosecutors had compelling evidence that Khan was innocent.
A Nov. 25 court hearing is set on the issue.
Khan claims he was unfairly arrested on flimsy evidence in 2011 in an FBI Taliban support probe. His father, Hafiz Khan, was convicted and is serving 25 years in prison. The Justice Department dropped all charges before trial against Irfan Khan.
