TALLAHASSEE, Fla. (AP) - The fate of Florida's largest private school voucher program is now up to a panel of state appeals judges who sounded skeptical about an ongoing lawsuit against the program.
Judges with the 1st District Court of Appeal held a nearly hour-long hearing Tuesday on whether a lawsuit filed by the Florida Education Association and others should be tossed out.
Nearly a year ago a circuit judge ruled that the association, the state's teacher union, did not have a legal right to challenge the program that serves more than 78,000 students.
The legal battle has been closely watched as supporters have mounted a public relations campaign to get the union and others to drop the lawsuit. Union officials maintain the program is unconstitutional, but supporters say it is structured in a way that it is legal.
