Court Overturns Ruling in Instagram Revenge Nude Photos Case

TALLAHASSEE, Fla.-- A state appeals court overturned the conviction of a man who logged into his ex-girlfriend's Instagram account and posted nude photos of her.

Judges found the 1970's era law did not apply to the circumstances of the case.

Mario Crapps was convicted on charges of unauthorized computer use and violating an injunction for protection against stalking. Crapps challenged the conviction, saying the 1978 law only applied to accessing any computer, computer system or network, and the Instagram application does not fall under that definition.

A three-member panel of the appeals court agreed with Crapps' argument.
