TALLAHASSEE, Fla. (WTXL) - A twice-convicted sexual predator is again behind bars after investigators say he sexually assaulted a mentally incapacitated person at the Apalachee Center.
Thelitus Batts Jr., has been charged with three counts of sexual assault.
He is a convicted sexual predator, according to FDLE records, and has been convicted of sexually battering victims under the age of 12 in Leon County in 2007 and 2018.
Tallahassee Police officers were called to the Apalachee Center on Dec. 26 about a victim that may have been sexually battered by Batts.
According to arrest documents, Batts was on Florida Department of Corrections probation at the time and had come to the Apalachee Center as a patient.
Investigators write that the victim "is mentally incapacitated and unable to give consent to sexual contact," and was not able to care for themselves long-term.
Documents say a witness told officers that he saw both the victim and Batts in the restroom. When they spoke to Batts, he initially stated that he followed the victim into the bathroom and wanted to have sex with the victim, but decided not to.
Batts stated, "Nothing will come back, because I didn't do nothing," and consented to a mouth swab for DNA comparison.
But when told he needed to provide his account of events to explain any DNA that may be found on the victim, documents say Batts admitted that he lied in his initial statement by saying, "It's kinda the same story but we did something. Sorry about that man."
Batts told investigators that he and the victim had sex three times. When asked if he thought it was okay to have sex with a mentally incapacitated person, documents say Batts stated, "Nah, I don't think so."
Based on the evidence, Batts was arrested and taken to the Leon County Detention Facility where he remains on with no bond.
