TALLAHASSEE, FL (WTXL) - An October crash has landed the allegedly drunk driver behind bars after his passenger died.
According to the Tallahassee Police Department, the original incident happened just before 10:15 p.m. on October 4, 2015. Police responded to a three car crash at Capital Circle SE and Blair Stone Road with serious injuries.
The driver of the first vehicle, 33-year-old Kevin Boland, had reportedly rear-ended two other cars, causing his vehicle to end up in a retention pond.
Boland was reportedly conscious but bleeding from his face. His passenger, Barry Clark, was unresponsive with his head hanging out of the passenger window, police said.
The driver of the second car was taken to the hospital with non-serious injuries. The driver of the third car was uninjured.
Officers noticed several open alcohol containers in Boland's car. A blood test was performed, and his blood alcohol content was reportedly .301, almost four times the legal limit.
Boland told police that he had been drinking in Wacissa while watching a NASCAR race and had driven to Tallahassee to buy more alcohol.
Clark was paralyzed from the shoulders down as a result of the crash. On May 11, officers reported that Clark had died due to his injuries.
Boland is charged with DUI manslaughter, two counts of DUI with injury and two counts of DUI with property damage.
