TALLAHASSEE, FL (WTXL) -- The city of Tallahassee will decide whether to settle or go to court for an officer involved shooting at Cheek's nightclub two years ago.

Officers were called to the nightclub after receiving reports of shots fired on May 29, 2014.

According to police, Duane Strong got into his car and was quickly trying to drive out of the parking lot.  When he was told to stop, police said that Strong sped up towards an officer.

Afraid of getting run over, the officer fired into the car. Strong was was hit several times, and later died from his wounds.

A grand jury found the officer's actions were lawful, but Strong's family filed a civil suit in 2015. The family is asking for a settlement of $325,000.

The city attorney, the risk manager, and the chief of police all support the settlement.

Commissioners will vote at the April 27th meeting to settle the lawsuit or continue on to a June 2016 trial date.
