TALLAHASSEE, Fla. (AP) - A man on Florida's death row after murdering his 10-month-old son and the baby's mother will get a new sentencing hearing.
The Supreme Court ordered the new hearing Thursday because the death sentence given to John Mosley for the slaying of the baby wasn't unanimous.
The court did uphold Mosley's convictions for murdering 40-year-old Lynda Wilkes and their son, Jay-Quan Mosley. He was sentenced to life for killing Wilkes.
Wilkes and her baby were reported missing in Jacksonville in April 2004, setting off a massive search. Nine days later Wilkes' burned body was found 55 miles away after a teenager who was with Mosley the night of the murders tipped off police.
Mosley suffocated the baby by tying it in a black garbage bag, which he later threw in a trash bin.
