MIAMI (AP) - A South Florida couple is suing to squash a town's ban on front-yard vegetable gardens claiming a violation of their constitutional rights.
A Miami judge held a hearing Wednesday on the lawsuit filed by Hermine Ricketts and Tom Carroll against the village of Miami Shores. The couple wants a ruling that the Miami Shores zoning ordinance prohibiting such gardens is an unconstitutional violation of their property rights.
Attorneys for the couple say they used the front-yard garden to grow vegetables for 17 years. They dug up the garden after Miami Shores officials said it violated an ordinance adopted in 2013 and was punishable by fines of $50 per day.
The town's lawyer says there is no rights violation and the ordinance is legal.
The judge did not immediately rule.
