TALLAHASSEE, Fla. (WTXL) - The woman who fell off the iconic donkey statue at El Jalisco's has voluntarily dismissed her lawsuit against the restaurant.

The dismissal was filed on Tuesday. 

This comes after the Southwood location denied most of the claims the victim, Kimberly Bonn, is suing for regarding the incident that happened back in 2015. 

On August 31, 2015, Bonn went to the restaurant for dinner. After dinner, she climbed up a life-size statue of a donkey at the restaurant to have her picture taken. 

At some point, Bonn slipped off the back of the statue and fell hard to the floor, sustaining significant injuries, including a fractured spine.

Bonn tried to sue, saying the restaurant failed to place any safety features (a saddle, ladder, stepping stool, etc.) on the statue, yet invited customers to climb on it for entertainment purposes. 

Lawyers for the restaurant state that at the time of the incident, Bonn was guilty of negligence. They claim that the restaurant wasn't guilty of negligence, saying that her actions directly led to her injuries.
