TALLAHASSEE, FL (WTXL) - A judge has denied a motion to allow new evidence to be entered in advance of the trail of Henry Segura.

As a result, Segura's trial is scheduled to begin February 22nd after being accused of killing Brandi Peters and her three children in 2010.

The judge also noted that the death penalty would be an option only if the legislature decides on a death penalty sentencing process before the trial. This comes after the U.S. Supreme Court found the state's death penalty system to be unconstitutional earlier this year.

This is a developing story. Keep checking WTXL on-air and online for more information.
