TALLAHASSEE, Fla. (WTXL) - A Tallahassee man is back behind bars after police say he broke into an apartment and fired shots at a man.

According to court documents, Tallahassee Police responded to Cactus Street for a home invasion robbery that occurred on Feb. 6.

Officers say the call notes indicated that the suspect had kicked in the door and had a gun. When officers arrived on the scene, they began speaking with the victim.

The victim told officers that he was sitting outside his apartment when 23-year-old Darius McNeely rushed toward him with a gun in his hands. The victim then quickly ran inside his apartment.

Seconds later, the victim said that McNeely started kicking the front door and the window of the apartment. After minutes of kicking, McNeely finally broke the window and entered the apartment.

Once inside the apartment, documents say McNeely began shooting at the victim. Thankfully, the victim was able to exit the apartment while McNeely was still chasing and shooting at him.

Documents say the victim kept running until he got away from McNeely and hid at a nearby McDonalds. Fortunately, the victim did not suffer any injuries.

Officers say they were familiar with McNeely because he was arrested in December for aggravated battery and is currently out on bond for that charge.

According to documents, McNeely was arrested and transported to the Leon County Detention Facility on Monday. He is being charged with burglary with assault or battery.
