Police: Argument about infidelity leads to shooting at Tallahassee apartment complex

TALLAHASSEE, Fla. (WTXL) - A Tallahassee man is in custody after an argument about his infidelity led to him shooting through an apartment door and threatening to kill his girlfriend.

According to court documents, on Nov. 3 at 5:40 a.m., officers responded to Holton Street Apartments after receiving a weapons call.

Officers say an anonymous caller reported there was yelling and gunshots coming from one of the apartments.

When officers arrived on the scene they saw a broken window and door. Officers spoke with the victim who identified the suspect as 38-year-old Devin Garmon.

Documents say the victim told police that she and Garmon were in a relationship and had been living together. The victim said Garmon broke the window of her apartment after she refused to let him in, due to the couple having an argument about infidelity.

The victim said she opened the door and tried to stop Garmon from coming in. He then attacked her and they stumbled into the apartment as the victim began fighting back.

According to the victim, Garmon broke away from the fight, ran into the bedroom and returned with a gun. He pushed the victim against the wall and put the gun to her chest and stomach while threatening to “blow her brains out.”

As the threats continued, Garmon put the gun under the victim’s shirt and told her if “she wanted to be out of this than she needed to shoot him.”

Documents say the victim told police that Garmon continued hitting her. Their neighbor, who was watching the victim’s kids, came to the apartment and said she needed assiantce with one of the children. Garmon let her go next door and tend to the child.

When Garmon realized she may have been trying to escape, he immediately went next door and tried to force himself inside the neighbor’s apartment.

When the victim didn’t let him in, he fired two shots through the door and kept threatening to “shoot it up” if he wasn’t let in. According to court documents, the victim said he also yelled that if the police were called he would kill her. At this point, the victim had already called the police.

Responding officers say the victim had cuts on her face.

According to documents, the audio from the 911 call picked up the sound from the gunshots and some of the altercation.

Based on the evidence officers gathered, Garmon was booked into the Leon County Detention Center where he is facing multiple charges including aggravated assault with deadly weapon and shooting into an occupied dwelling.
