TALLAHASSEE, FL (WTXL) - Former Florida State University quarterback Jameis Winston has filed a countersuit against Erica Kinsman, the former FSU student who accused Winston of sexual assault in December 2012.
Last month, Erica Kinsman filed a civil lawsuit against Winston for damages regarding the sexual assault. In 2013, the State Attorney's office chose not the press charges against Winston, saying there wasn't enough evidence.
According to Winston's countersuit, which was filed in an Orlando federal court today, begins by saying "Jameis Winston did not rape Erica Kinsman."
The 63-page lawsuit says Kinsman "mounted a false and vicious media campaign to vilify Mr. Winston."
The documents say everything that occurred that December 2012 night was consenual, detailing the actions that took place after the two, along with friends, left the club Potbelly's and headed towards his apartment.
According to the documents, Winston is asking for a jury for this trial and asks for damages and attorney fees. The lawsuit lists three counts against Kinsman: defamation per se, defamation, and tortious interference with prospective business advantage.
Kinsman is named here because she has made her name public in other legal actions.
