South Florida Judge Attacked During Hearing

MIAMI (AP) — A South Florida judge is back on the bench a day after he was attacked by a defendant during a court hearing.

Circuit Judge Robert Luck was hearing a case Thursday when 57-year-old Ricardo Garganelly charged him.

The Miami Herald (http://hrld.us/1J9eAhH ) reports Luck suffered a scratch to his neck and a laceration on the back of his head. He declined medical attention from paramedics.

Garganelly was in the courtroom after being declared mentally incompetent to proceed to trial for battery on someone over 65.

He had been out of custody but was ordered to be committed to a state psychiatric hospital just before the attack.

He was arrested and charged with battery on an elected official. Jail records don't list an attorney.

Luck has now recused himself from the case.
