DCF tip leads to Tallahassee man's arrest for lewd and lascivious battery

TALLAHASSEE, Fla. (WTXL) — The Tallahassee Police Department has arrested an 18-year-old for lewd and lascivious battery on a minor after receiving a tip from the Department of Children and Families.

Jevore Smitty Jr., 18, has been charged with two counts of lewd and lascivious battery.

According to probable cause documents, the Tallahassee Police Department received a hotline tip from the Department of Children and Families on Jan. 25.

The tip alleged that a 14-year-old child had admitted to having sex with Smitty.

Investigators who spoke to the child in February say the victim was aware that Smitty was 18 and first had sex with him on Jan. 21.

"The victim also revealed Smitty Jr. provided her with a cellphone to communicate with him," investigators wrote. "The victim stated Smitty Jr. provided [the victim] with the cellphone after [the victim's] mother had spoken to him and took [the victim's] cellphone."

On Feb. 14, just two days after the victim's interview with police, a school resource officer at a Tallahassee high school contacted investigators and informed them that the victim had left school for most of that morning and returned around 1 p.m.

When the victim returned, the 14-year-old told the school resource officer that the victim was with Smitty that morning and admitted that they had sex again.

Based on the evidence, investigators found probable cause to charge Smitty with two counts of lewd and lascivious battery.
